Effective date: July 26, 2025

This End-User License Agreement (“EULA”) is between Krimsnatch LLC (DBA WikiMapping / Steve Spindler Cartography) (“WikiMapping”, “we”, “us”) and the organization or person that creates a WikiMapping account (“Customer”, “you”). By using the Service you agree to this EULA.

1) Definitions

Service.
The WikiMapping web application, APIs, and related support.
Organization.
One legal entity (agency, nonprofit, firm) holding a subscription.
Project.
A discrete WikiMapping map engagement with its own settings.
BYO Token.
Customer-supplied access tokens (e.g., Mapbox, translation).
Public Project.
A project you mark as public; it can be viewed without login.

2) License & scope

Org-wide annual license.
For the Subscription Term, WikiMapping grants Customer a non-exclusive, non-transferable right to use the Service for Customer’s projects. Unlimited collaborators are allowed within the Customer’s legal entity. Subconsultants may collaborate within Customer’s projects but may not resell access or operate independent programs under Customer’s license.
Per-project license (Project Pass).
A time-boxed license (e.g., 6 months) for a single project. It may be credited toward an annual plan if you upgrade within the promotional window in your order form.
Public Projects.
If you toggle a project to public, its content becomes accessible to anyone with the link. You control that toggle and can revert to private at any time.

3) Pricing, renewals & fair use

Annual + Per-project options.
Pricing follows your order form (annual Organization license and/or per-project pass).
Unlimited collaborators (no seat meter).
We do not charge per named user.
Fair-use & price resets.
If annual-plan usage materially exceeds typical organizational use in a way that threatens service stability or cost structure (e.g., persistently extreme map traffic without BYO Token), we may propose a plan change or adjust the renewal price. If you decline, we may terminate at the end of the current term with pro-rata refund for any unused prepaid months.
Taxes & fees.
Prices exclude applicable taxes and third-party pass-through fees you incur with your own providers.

4) Third-party services & BYO tokens

Customer-supplied keys.
We may require you to use your own provider keys/tokens (e.g., Mapbox tiles, translation). When configured, all calls are billed by those providers under your account; you accept their terms and charges. We are not liable for provider throttling, outages, or fees tied to your keys.
Fallback.
If a BYO Token fails (e.g., 401/403), we may temporarily fall back to our token for continuity and prompt you to correct the key, or we may suspend high-traffic features until your token is restored.

5) Public records & right-to-know

WikiMapping is a private vendor and is not the records custodian for your agency. We do not respond to third-party “Right-to-Know,” FOIA, or similar requests. Such requesters should contact the owning agency. Upon an authorized admin’s request, we will provide reasonable data exports to the Customer to help you meet your obligations. We will comply with valid court orders directed to us.

6) Content & acceptable use

You are responsible for content you publish. No unlawful, harassing, discriminatory, or harmful content. We may remove or suspend content or projects that violate law or this EULA.

7) Accessibility

We aim to support WCAG 2.1 AA usability patterns. Your project content (colors, images, copy) should also follow accessibility guidance.

8) Support

Email mapteam@wikimapping.com or call 215-887-5986. Project owners can grant or revoke collaborator access at any time.

9) Data export & deletion

Authorized admins can download project data (e.g., GeoJSON/CSV). We may retain short-term backups for continuity; upon termination we will disable access and process deletions consistent with our Privacy Notice.

10) Payment, refunds & suspension

Fees are due as stated on your order. We may suspend access for non-payment after notice. Any stated outcome-based guarantees or credits apply only as written in your order form.

11) Term, termination & survival

This EULA runs with your active order. Either party may terminate for material breach after notice and a cure period, or at end of term. Sections on IP, confidentiality, limitations, and dispute resolution survive termination.

12) Intellectual property

We retain all IP in the Service; you retain all rights in your data.

13) Disclaimers & liability limits

Service is provided “as-is.” We disclaim implied warranties to the extent allowed by law. Our aggregate liability will not exceed the fees paid by you in the 12 months preceding the claim.

14) Governing law

Pennsylvania law (without regard to conflicts rules). Venue: Pennsylvania courts.

15) Changes

We may update this EULA; when we do, we will update the date above. Continued use after notice indicates acceptance.
